Shipper Alert! Trade Court Rules Against Trump’s 10% Global Tariff

The U.S. Court of International Trade ruled against the Trump Administration’s usage of Section 122 of the Trade Act of 1974 to implement a broad 10% tariff on imports to the U.S.

President Trump quickly put this tariff in place after the Supreme Court ruled against his usage of the International Emergency Economic Powers Act (IEEPA) to authorize large-scale reciprocal tariffs.

Just like the president wasted no time in implementing the Section 122 tariff, its opponents wasted no time in challenging it.

Expect the ruling to be appealed, with a good chance of the case going right up to the Supreme Court again.

The Court of International Trade’s decision was made by a vote of 2-1. If appeals fail to reverse the decision, shippers will likely see more tariff refunds due to them, like the IEEPA ones that are already in process for many.
